Homeowners’ associations are organizations whose primary goals include advancing and safeguarding members’ shared interests and supporting the growth of their local communities. A housing project seeking registration must come to the HLURB. Once the processes for the adjudicatory mechanism have been followed, the HLURB will decide which association will be registered if two (2) or more associations are seeking membership from the same subdivision.

The Homeowners Association then has the right to collect reasonable fees and charge reasonable fines and operations of the association to cover necessary operating costs, according to restrictions and requirements set forth by law, board rules, and the group’s bylaws in each housing unit as well as raise funds for the said activities.

They also have the right to conduct meetings in community spaces for every member or for the concerned parties. The board of directors can also decide to require basic community services depending on how they will put in the association by-laws.

An HOA Member Has Lots of Perks

In a word, an HOA raises the physical and market property values that are subject to its control by protecting it. Also, the HOA property owners have the right to promptly receive deposits required as long as the requirement for the deposit has been compiled in line with the pertinent laws of the association. In addition, they have the right to be part of the community mortgage program.

The property owners also have the right to attend association meetings, elections, and referenda as long as he/she is still a bonafide member and follows the pertinent rules of the organization.

An HOA Member Also Has Responsibilities

As regulated by the association’s board, the association members must attend association meetings and administrative proceedings as necessitated by the board members. They are also required to pay association fees which are utilized for necessary operational expenses.

However, these reasonable fees must be used to uphold community rules as well as the rights of the association members. The homeowner must also regularly maintain his residential real property which is usually noted by the association secretary. The HOA member must pay membership fees and other special assessments. If the tasks are not accomplished, the property owner must be ready when the HOA collects reasonable charges if there are offenses against other pertinent laws in the property owned.
